Licensing — Open vs Open-Source for Local Models

Apache-2.0 and MIT = genuinely open source. Llama, Gemma, Mistral research licences and OpenRAIL = "open weight but restricted." Downloading locally does not exempt you from a vendor's Prohibited Use Policy.

The Open Source Initiative's Open Source AI Definition (OSAID 1.0) requires weights and architecture and usage information to be made publicly available under OSI-approved terms. Most "open" LLMs do not meet that bar — they are open weight but restricted. OSI considers RAIL-style and model-weight licences non-compliant.

Key gotchas for local deployment: - Ownership of outputs is usually yours, but under Llama 4 a model trained on Llama outputs must be named "Llama-…"; under OpenRAIL the behavioural use bans propagate to every derivative and bind outputs. - Acceptable-use terms travel with the weights. Downloading locally does not exempt you from a vendor's Prohibited Use Policy (Gemma) or AUP (Llama). - OpenRAIL-M (BLOOM, Stable Diffusion, StarCoder): commercial use allowed but surveillance/disinformation/discrimination/weapons bans follow every derivative. - Meta has signalled a shift toward closed releases (Muse Spark / Meta Superintelligence Labs, April 2026) — don't assume future Llama-family weights stay available. - Practical rule: Apache-2.0 and MIT = genuinely open source. Llama, Gemma, Mistral research licences and OpenRAIL = "open weight but restricted."
